Record-Keeping Compliance Statement

This statement sets out the position of Aura Digital LLC under 18 U.S.C. § 2257 and § 2257A and 28 C.F.R. Part 75 with respect to content appearing on the Aura platform.

Aura Digital LLC operates a platform on which all content is created and uploaded by its users. Aura Digital LLC's activities with respect to that content are limited to the transmission, storage, retrieval, hosting, and formatting of content uploaded by users, and to good-faith moderation of that content. Under the exclusion in 18 U.S.C. § 2257(h)(2)(B), an entity whose activities are limited in this way is not a producer. Aura Digital LLC therefore is not the producer — as that term is defined in 18 U.S.C. § 2257 and § 2257A and 28 C.F.R. § 75.1(c) — of any content appearing on the platform, and it does not create, commission, direct, or select the content its users upload.

Aura Digital LLC's good-faith moderation of user content — removal, restriction, and classification of content, and enforcement of its consent and conduct policies — does not affect this position. 18 U.S.C. § 2257(h)(2)(B) expressly preserves the exclusion for activity described in section 230(c) of the Communications Act of 1934 (47 U.S.C. § 230(c)).

Every user is required to be at least 18 years of age to access the platform, create an account, or upload content. Users represent and warrant that they are at least 18 years old and that all individuals depicted in any content they upload were at least 18 years of age at the time the content was created. Content depicting minors in any context is strictly prohibited and will be removed and reported as required by law.

Records Requests

Because Aura Digital LLC is not a producer of the content appearing on the platform, it does not assert a record-keeping obligation under 18 U.S.C. § 2257 or § 2257A and maintains no records under those sections. No custodian of records is designated and no physical records location is maintained, because no such records exist.

If Aura Digital LLC's activities with respect to content ever change such that a record-keeping obligation attaches, it will designate a custodian of records and a physical records location and will update this statement accordingly.
